However, if the person has too much income, owns their home, or has too much equity, or valuable items, they can still get a Chapter 13 reorganization bankruptcy where they repay a significantly reduced amount of their debt through the bankruptcy trustee over a three to five-year repayment period.
The exciting part is while someone is in that repayment period with Chapter 13, the Automatic Stay provision of the Bankruptcy Code makes them off limits to any creditors or people trying to collect. They make their payment to the Chapter 13 trustee and all is well. People who learn about the details of Chapter 13 often say they would have taken advantage of these laws years ago!
